BirdCatch — Wildlife Photography Game

Welcome to BirdCatch! By creating an account or using the app, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using BirdCatch, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the app.

You must be at least 13 years old to use BirdCatch. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these terms on your behalf.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate information when creating your profile
• Choose a username that does not impersonate another person or entity
• Notify us immediately of any unauthorized use of your account
• Not share your account with others

3. Prohibited Content

BirdCatch is a family-friendly app. The following content is strictly prohibited and will result in immediate account suspension or permanent ban.

You agree not to upload, submit, share, or display any content that:

• Is sexually explicit or pornographic — including nudity, sexual acts, or sexually suggestive imagery of any kind
• Contains hate speech or hateful imagery — including content that promotes discrimination, hostility, or violence based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Depicts graphic violence or gore — including disturbing imagery of injury, death, or suffering
• Includes extremist or terrorist content — including symbols, propaganda, or material associated with hate groups or violent extremist organizations
• Is illegal — including content that depicts or facilitates illegal activity
• Harasses or threatens other users
• Violates the intellectual property rights of others

BirdCatch is intended for wildlife photography. All photos submitted must be photographs of birds or wildlife taken by you personally. Submitting photos that are not your own, downloaded from the internet, or contain the prohibited content above violates these Terms.

4. AI Content Moderation

BirdCatch uses automated AI-powered content moderation to screen all photos submitted through the app before they are processed or displayed. By submitting a photo, you consent to this automated review.

The AI moderation system checks for:

• Inappropriate or prohibited content as described in Section 3
• Photos that do not appear to be original photographs taken by the user
• Images that are inconsistent with the wildlife photography purpose of the app

Photos flagged by our moderation system may be blocked from submission. Repeated violations are logged and reviewed by our team and may result in account suspension or termination.

If you believe a photo was incorrectly flagged, you may submit a dispute through the in-app dispute system. We review disputes on a best-effort basis.

5. Content Violations and Enforcement

When our systems detect a potential violation of Section 3, we log the user account, the nature of the violation, and relevant metadata for review. We do not store the prohibited content itself.

Depending on the severity and frequency of violations, we may:

• Block the specific photo from being submitted
• Issue a warning to your account
• Temporarily suspend your account
• Permanently terminate your account
• Report the content to appropriate authorities where legally required

We reserve the right to take action at our sole discretion. Accounts terminated for content violations are not entitled to restoration of points, streaks, or other game progress.

5A. User Reporting and Blocking

BirdCatch provides tools for users to report content and block other users:

• Reporting: You may report catches or chirps that you believe violate these Terms. Reports are reviewed by our moderation team. False or abusive reporting may result in action against the reporting account.
• Blocking: You may block other users. Blocked users will not see your content in their feeds, and you will not see theirs. Blocked users are not notified of the block.
• Auto-moderation: Content that receives reports from multiple distinct users may be automatically hidden from public view pending manual review. Content owners are notified when their content is hidden and may contact birdcatchsupport@gmail.com to appeal.
• Takedown: We reserve the right to permanently remove any content that violates these Terms, with or without notice. Repeated violations may result in account termination.

6. Fair Play and Anti-Cheat

BirdCatch uses automated systems to detect cheating, including submitting downloaded or stolen photos. You agree that:

• All photos must be taken by you personally using your device camera
• You will not manipulate location data or timestamps
• You will not use automated tools, bots, or scripts to generate scores
• Violation of these rules may result in score removal and account termination

7. User-Generated Content

By submitting photos and content to BirdCatch, you grant us a non-exclusive, royalty-free license to display that content within the app for purposes of the game (leaderboards, BirdDex, etc.). You retain ownership of your photos.

You represent and warrant that you own or have the right to submit any content you upload, and that your content does not violate these Terms or any applicable law.

8. Points, Scores, and Game Currency

Points, scores, streaks, trophies, and other in-game elements have no monetary value and cannot be transferred, sold, or exchanged for real money or goods. We reserve the right to adjust, remove, or reset scores at any time, including in cases of rule violations or technical corrections.

9. Privacy

Your use of BirdCatch is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

10. Disclaimers and Limitation of Liability

BirdCatch is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, accuracy of AI scoring, or preservation of your game data. To the maximum extent permitted by law, our liability for any claim arising from use of the app is limited to the amount you paid us in the past 12 months (if any).

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the app or by email. Continued use of BirdCatch after changes take effect constitutes acceptance of the new terms.

12. Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles.
